Terms & Conditions and Privacy Policy

The Kwiksave Gift Scheme is operated by Sloane Ltd.

These Terms & Conditions govern the collection and use of points and set out the terms of the contract between The Kwiksave Gift Scheme (“us/we”) and each Member. As a Member, you can start collecting points by collecting the packaging material from any of the participating brands and bringing them to our Centre in Malta or Gozo. We will add these up and credit the value in your account. Points can be exchanged for free gifts in Malta (Homemate in Mriehel, Mosta, Shoreline, The Point or Zejtun) and in Gozo (Kwiksave Center, Ninu Cremona Street, Victoria).

If you register with the Kwiksave Gift Scheme you automatically accept these Terms & Conditions which are subject to changes at any time. We reserve the right to verify the individual’s eligibility to the Kwiksave Gift Scheme and may refuse an application for any good reason.

The Member is responsible to update any personal information if changes arise. The Member is also responsible to ensure the password of their account is kept in a safe and secure location at all times. The Kwiksave Gift Scheme will not be liable for any unlawful or misuse of the Member’s Kwiksave Gift Scheme Card or account.

SIGNING UP TO THE KWIKSAVE GIFT SCHEME

Signing up to the Kwiksave Gift Scheme is free. Customers can sign up as follows:

  1. Kwiksave Website: Customers can visit www.kwiksave.com.mt and register online.
  1. Kwiksave App: The customer can immediately download the app via Google Play or Apple Store and register.
  1. At one of our centres in Malta or Gozo

The member can request a physical card or can use the app to collect and redeem points. The card can be collected from one of our centres in Malta or Gozo.

RULES TO BECOMING A MEMBER

  • Only one member is permitted per household.
  • ID Card or Drivers Licence must be presented to open a new account and address must match.
  • Credit is valid for a period of 2 years.
  • Credit cannot be transferred from one account to another.
  • Credit cannot be utilised unless membership card or the app is presented.
POINTS

EARNING KWIKSAVE POINTS

The Kwiksave Gift Scheme reserves the right to modify the way in which points are earned and redeemed.

We will only be liable to a Member who suffers loss as a result of our breach of these Terms & Conditions and, if so, our sole liability will be to credit to the relevant Kwiksave Gift Scheme Account any points which have been wrongly deducted or should have been credited but were not. 

Points earned will be available for redemption instantly once these have been counted. The count by our employees is final. We are not responsible for any limitations of the Internet or technical malfunctions of any communications network, online system or computer hardware or software that may affect the transaction of points.

We will correct a Kwiksave Gift Scheme Account if it is shown to our reasonable satisfaction to be wrong but, unless there are clear records showing this, our decision is final.

REDEEMING KWIKSAVE POINTS

Members can redeem any points that they have collected at Homemate in Mriehel, Mosta, Shoreline, The Point, Zejtun or at our centre in Gozo upon presentation of their Kwiksave Gift Scheme App or Card. If a Member does not redeem the entire value of his/her points, the balance value will remain in the Member’s account and can be used towards the future transactions.

To redeem points a signature by the Member may be requested. Presentation of ID card may also be requested as a security measure.

Kwiksave Gift Scheme points available for redemption cannot be exchanged for cash. If the value of the purchase is more than the value of the Kwiksave points the balance amount must be paid by the Member using a valid payment method.

If we suspect fraud or misconduct, redemption may be refused or cancelled.

LOST CARD

The Kwiksave Gift Scheme Card is the property of Sloane Ltd and must be returned to us on request or destroyed when no longer valid for use. If a Kwiksave Gift Scheme Card is lost or the holder thinks an unauthorised person has become aware of their password, they should contact us on 21234758/9 (Malta) or 21560176 (Gozo).

UNSUBSCRIBING

With reference to marketing communication, you can withdraw your consent from marketing information at any time by sending us an email on contactus@kwiksave.com.mt, by clicking unsubscribe on any email you receive from us or by unticking this option from the App by going to the More > Profile.

MEMBER INACTIVITY

If a Member has a balance of €1 or less and has been inactive for 5 years or more, Sloane Ltd have the right to remove this Member from the database. Members who have a balance of points in their account will not be deleted from the Kwiksave Gift Scheme database.

GENERAL

The Kwiksave Gift Scheme is only available in Malta and Gozo and shall be governed by the laws of the country. Points can only be collected or redeemed locally. 

We may make changes to these Terms & Conditions.  We strive to keep our Members up to date with any changes in the scheme and will give the Member as much notice as we reasonably can. Earning or redeeming points on a Kwiksave Gift Scheme account will constitute acceptance of the revised Terms & Conditions. 

We may suspend or terminate The Kwiksave Gift Scheme but will give as much notice as we reasonably can before we do so. If this happens, all Kwiksave Gift Scheme Accounts will be suspended or terminated. If we sell or transfer the Kwiksave Gift Scheme to another company we may transfer all of our rights and obligations under these Terms & Conditions without any further consent and may disclose or transfer all information we hold about the Members to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Member in respect of the use that can be made of such information by such other company.

We may use third parties to facilitate one or more elements of the Kwiksave Gift Scheme.

While the Kwiksave Gift Scheme will endeavour to ensure that the services, benefits, facilities and arrangements as expressed or advertised, the Kwiksave Gift Scheme will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, whether whole or part, of any such services, benefits, facilities or arrangements.

These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. 

We may, on notifying the Member, immediately suspend or terminate their rights, refuse to award Points, withdraw Points, refuse the right to redeem Points collected and/or close any relevant Kwiksave Gift Scheme Account, if they breach these Terms & Conditions, if we reasonably believe that they have dealt with points in a manner not permitted by these Terms & Conditions, if there is any theft from or misconduct in connection with us, if they supply false or misleading information to us or if they are abusive or offensive to any member of our staff. 

PRIVACY POLICY

Sloane Ltd, operating the Kwiksave Gift Scheme, shall process all personal data collected in connection with The Kwiksave Gift Scheme in accordance with the Data Protection Act (Chapter 586 of the Laws of Malta) and the General Data Protection Regulation (EU) 2016/679 (GDPR).

Collection of Data

The table below explains the purpose of the information requested upon signing up to The Kwiksave Gift Scheme:

Home AddressThis will primarily be used to mail physical vouchers to Members as well as confirm the one-household policy. This can also be used for advertising purposes if the customer has agreed to the marketing consent.
  

If a Member notifies us that they do not wish to receive marketing information from us or be contacted by us for promotional purposes in connection with The Kwiksave Gift Scheme we will comply with such request. 

What information will we use?

We will collect and use information about the Member activity within The Kwiksave Gift Scheme. This information includes registration details, information about the use of the Member’s Kwiksave account and any transactions made.

We will only use your personal information submitted by you to administer your account and to provide the products and services you have requested from us. With your permission, we may send you emails about us, new brands and products in the scheme and other updates. You can stop receiving marketing communication from us at any time. You can do this by clicking on the ‘unsubscribe’ link in any email or by contacting us on contactus@kwiksave.com.mt.

How will your information be used?

We may use your information to:

  • operate The Kwiksave Gift Scheme and ensure that the applicable terms and conditions are observed;
  • analyse how you use The Kwiksave Gift Scheme and our marketing channels such as our website and our App;
  • assess the effectiveness of our marketing activities;
  • inform you of any points credited to your account in case of any marketing promotions;
  • understand your behaviour based on the information available to us and to send or show you information, offers, surveys and online advertisements for the products or services which we believe are most likely to interest you. This is only applicable if you have opted in to receive brand offers and updates. 

Who will we share your information with?

We may share your information with:

  • Homemate Ltd, where the Member can redeem points for gifts;
  • analytics providers and advertising and media companies to enable them to show you adverts or offers which may interest you;
  • our professional advisors;
  • any law enforcement agency, court, regulator, government authority or other third party where we believe this is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party.

Once you leave our website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service. When you click on links on our website, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

How long will we keep your Personal Data?

What are your rights at law?

You have the right to request access to your personal data as well as to rectify and, where applicable, erase any inaccurate, incomplete or immaterial personal data; to request a restriction of processing, to object to any processing and to request data portability for the data held by The Kwiksave Gift Scheme.

If you consider that the processing of your personal data is carried out in an unlawful manner, you may lodge a complaint with the Information and Data Protection Commissioner using the following email address: idpc.info@idpc.org.mt.

As a data subject, you have a right to request the erasure of your personal data (the right to be forgotten) subject to our right to retain personal data for the period established in the previous section.

Age of Consent

By using this site and App, you represent that you are at least the age of majority in your state, county, province, region or country of residence and you have given us your consent to allow any of your minor dependents to use this site.

Changes to this Privacy Policy

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our organisation is acquired or merged with another company, your information may be transferred to the new owners.
